The Supreme Court confirms the right of Caixa Leasing and Factoring workers to receive CGD social services

STEC announced the ruling of the Supreme Court of Justice, which recognized the right of a union member to register in the social services of the CGD, rejecting the appeals of Caixa and the social services.

“CGD has therefore been requested to enhance the registration of this partner in SSCGD,” STEC offers.

The court ruled that “during the suspension of an employment contract, the rights, duties and guarantees of parties who do not assume the effective provision of work are preserved” and that “noThese rights include social benefits for the worker included in the term of the employment contract, which are transferred with the transfer of the facility to the transferee.

The case dates back to December 2020, when CGD Group's company, CLF – Caixa Leasing e Factoring – Sociedade Financeira de Crédito, was merged into Caixa Geral de Depósitos.

“Since this integration took place, through the merger, the CGD management refused to register dozens of workers, in addition to all those who were at that time in pre-retirement status, coming from that company (CLF), in the services of social workers of the CGD who, says the union, Among other things, providing medical assistance to workers and their families.

“STEC, from the beginning, and on more than one occasion, objected to this discriminatory measure by the CGD management, and once the dialogue with the CGD was exhausted, it provided legal support to all CLF affiliates who turned to it, and sponsored the necessary judicial measures against the CGD with the aim of restoring legitimacy,” he adds. .

“It has now finally been proven that the actions of the CGD constitute a situation in violation of the Statutes of the SSCGD, the Company Agreement and the Labor Code, with only the economic objective of reducing labor costs underlying it,” the union says.

“This is an important decision by this court which will serve as a reference for other workers and CLF retirees who wish to register with the SSCGD,” concludes the CGD workers’ union.
