President Luiz Inacio Lula da Silva approved the law that establishes a plan for the resumption of work in the areas of basic education, vocational education and health. On the initiative of the executive authority Law No. 14719 of 2023 It was published on Friday (3) in The official diary of the federation.

The government intends to invest about R$4 billion in completing 3,540 school projects in 1,659 municipalities, thus opening 450,000 places in public education networks by 2026. The resources come from the National Fund for the Development of Education (FNDE) and the project completion deadline. The term of work is two years, with the possibility of extension for a similar period.

“The plan could eventually include 1,200 early childhood education institutions (daycare centers and nurseries), nearly a thousand primary schools, plus a few dozen technical and vocational secondary schools, a hundred school renovations or expansions and at least About 1,260 sports fields or covers,” highlights the project rapporteur in the Education Committee, Senator Teresa Leitao (PT-PE).

It was approved at the beginning of October in the plenary session of the Senate 4,172/2023, which created the standard, also ensures the provision of resources from the Unified Health System (SUS) for projects considered priority by states, the Federal District and municipalities. After restructuring the financing, the planned works will have to be completed within 24 months, with the possibility of one extension for the same period. The renegotiation will include a new commitment period and correction of the values ​​corresponding to the unimplemented portion, and may include changes to the project.

The rules for prioritizing actions will be determined by the executive authority, taking into account the percentage of implementation and the year of start. Preference should be given to businesses in rural, indigenous and quilombola communities as well as in municipalities that have suffered natural disasters in the past ten years. Businesses with violations may be included in the plan, provided that this does not prejudice the definition of responsibilities for violations.

The bill was sent to Congress by the executive branch in August, after the expiration of a temporary measure that had the same purpose (MP 1174/2023). In the House of Representatives, provisions were added to resume work in the cultural sector and renegotiate debts with the Student Finance Fund (Vice – Law No. 10260 of 2001) and changes the contribution percentage of private educational institutions to the FG-FIES Guarantee Fund, which is a required condition so that students can count on 100% of the monthly fees financed.

In the cultural field, the law stipulates that during the period of validity of the new Growth Acceleration Program (PAC), the Ministry of Culture will determine the guidelines for the application of resources from the National Alder Blank Policy for the Promotion of Culture (Law No. 14399 of 2022).
