While the vast majority of Portuguese professionals go on vacation, there are many uncertainties that arise when scheduling this period, the number of days due to them, and whether it can be given up for pay, among other things.

1. Holiday days you are entitled to

3. Interruption of leave period
The employment alert also notes that “a professional may have to interrupt his vacation in exceptional cases at the request of the organization, but only in emergencies related to the operation of the company. In this case, the employer can change the vacation days already set by his team.”

He adds, “For this, the company needs to provide a justification, as well as compensate the worker for any damage suffered, such as the flight or accommodation that has already been booked, provided it is duly proven.”

4. The effect of sick leave on the right to leave
“If the professional falls ill during the leave period, he may be suspended, provided that the employer is informed of this circumstance and that the professional has evidence of the condition of the illness, through a sick leave or a medical certificate.
When the professional is laid off, he can continue to take the leave, if he still has days to enjoy,” he points out.

However, he adds, “Unused days can also be used at another time, by agreement between the parties. If this is not possible, it will be up to the employer to schedule these days.”

5. Accumulation of rest days
“Although the holidays must be used in the calendar year to which they correspond, it is possible to accumulate days from year to year. However, they must be enjoyed by April 30 of that year, on a date approved by the company.

However, according to the portal, “There is only one situation in which company approval is not required – if a professional wants to take vacations with a family member residing abroad and is therefore able to accumulate days from the previous year and enjoy without the need for an agreement.
